Meaning of consumer&#8221; tab_id=&#8221;1786458674591-1c24a81d-a880&#8243;][vc_column_text]For the purposes of this document, a consumer is a person to whom goods, services or rights are supplied for non-professional use by a person carrying out a professional economic activity for profit.<\/p>\n<p>This information is therefore primarily intended for natural persons purchasing goods or services for private purposes rather than in connection with a trade, business, profession or industrial activity.<\/p>\n<p>Disputes arising from contracts entered into by companies, trade professionals, resellers, contractors, developers, architects or other organisations acting in the course of their professional activities will not generally constitute consumer disputes.<br \/>\n[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;4. Contacting Decorpita first&#8221; tab_id=&#8221;1786458700003-d73e62d7-3f52&#8243;][vc_column_text]Where a consumer has any question, complaint or concern relating to a product, service, proposal, order, delivery, installation, warranty or after-sales service, the consumer should first contact Decorpita directly.<\/p>\n<p>Direct contact enables Decorpita to:<\/p>\n<p style=\"padding-left: 40px;\">a) Identify the relevant matter;<\/p>\n<p style=\"padding-left: 40px;\">b) Review the applicable documents;<\/p>\n<p style=\"padding-left: 40px;\">c) Request further information;<\/p>\n<p style=\"padding-left: 40px;\">d) Assess the circumstances;<\/p>\n<p style=\"padding-left: 40px;\">e) Contact the relevant departments, suppliers or service providers;<\/p>\n<p style=\"padding-left: 40px;\">f) Propose an appropriate solution where applicable.<\/p>\n<p>&nbsp;<\/p>\n<p>Portuguese public guidance recommends that consumers first seek to resolve the matter directly with the relevant business and retain evidence of that contact.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;5. Information to include&#8221; tab_id=&#8221;1786458770657-0fd736fa-c6dc&#8221;][vc_column_text]To enable Decorpita to review the matter properly, the complaint should include, where possible:<\/p>\n<p style=\"padding-left: 40px;\">a) The consumer\u2019s name and contact details;<\/p>\n<p style=\"padding-left: 40px;\">b) Customer number, where available;<\/p>\n<p style=\"padding-left: 40px;\">c) The number and date of the proposal, quotation, order or invoice;<\/p>\n<p style=\"padding-left: 40px;\">d) Identification of the relevant product, service or project;<\/p>\n<p style=\"padding-left: 40px;\">e) The place of purchase, delivery or installation;<\/p>\n<p style=\"padding-left: 40px;\">f) A clear description of the facts;<\/p>\n<p style=\"padding-left: 40px;\">g) The date on which the matter was identified;<\/p>\n<p style=\"padding-left: 40px;\">h) Details of any action already taken;<\/p>\n<p style=\"padding-left: 40px;\">i) The remedy or outcome requested;<\/p>\n<p style=\"padding-left: 40px;\">j) Relevant documents, photographs or other evidence.<\/p>\n<p>&nbsp;<\/p>\n<p>Consumers should not provide identification documents, full banking details, passwords or other personal information that is not required to review the complaint.<\/p>\n<p>Decorpita may request further information where necessary to confirm the order, assess the matter or contact the relevant manufacturer, supplier, carrier, installer or other party.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;7. Handling complaints&#8221; tab_id=&#8221;1786458819434-6ec1a72b-ad5b&#8221;][vc_column_text]Complaints will be referred to the appropriate department and assessed taking into account:<\/p>\n<p style=\"padding-left: 40px;\">a) The facts submitted;<\/p>\n<p style=\"padding-left: 40px;\">b) Available documentation;<\/p>\n<p style=\"padding-left: 40px;\">c) The applicable proposal, order or contractual terms;<\/p>\n<p style=\"padding-left: 40px;\">d) Product technical specifications;<\/p>\n<p style=\"padding-left: 40px;\">e) Manufacturers\u2019 guidance;<\/p>\n<p style=\"padding-left: 40px;\">f) Statutory consumer rights;<\/p>\n<p style=\"padding-left: 40px;\">g) Applicable warranty and after-sales conditions;<\/p>\n<p style=\"padding-left: 40px;\">h) The responsibilities of the relevant parties.<\/p>\n<p>&nbsp;<\/p>\n<p>Submitting a complaint does not automatically constitute acknowledgement by Decorpita of a defect, lack of conformity, breach of contract or liability.<\/p>\n<p>A decision will be made following assessment of the available evidence and, where necessary, an inspection, technical assessment or consultation with the relevant parties.<\/p>\n<p>Decorpita will seek to respond as soon as reasonably possible, subject to the time required to obtain information, carry out technical checks or contact third parties.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;8. Physical Complaints Book&#8221; tab_id=&#8221;1786458860669-40eb6962-c016&#8243;][vc_column_text]Decorpita provides a physical Complaints Book at its establishments in accordance with applicable Portuguese law.<\/p>\n<p>Consumers may request the physical Complaints Book at any Decorpita establishment open to the public. Access to the Complaints Book must not be made conditional on the presence of a manager or the prior submission of another complaint.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;9. Portuguese Electronic Complaints Book&#8221; tab_id=&#8221;1786458884521-ef282c0b-057f&#8221;][vc_column_text]Consumers may also submit a complaint through the Portuguese <strong>Electronic Complaints Book \u2014 Livro de Reclama\u00e7\u00f5es Eletr\u00f3nico<\/strong>.<\/p>\n<p>Access to the official platform should be provided through a clearly visible button or link in the Website footer.<\/p>\n<p>The provision of the Electronic Complaints Book and publication of access to it on the business operator\u2019s website are mandatory for suppliers of goods and service providers subject to this regime.<\/p>\n<p><strong>Website button<\/strong>:<\/p>\n<p>Access the Portuguese Electronic Complaints Book<\/p>\n<p>The button should direct Users to the official Electronic Complaints Book platform.<\/p>\n<p>Complaints submitted through the platform are forwarded to Decorpita and to the competent supervisory or regulatory authority in accordance with the operation of the platform.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;10. Internal complaints and the Complaints Book&#8221; tab_id=&#8221;1786458913157-bf76c602-9fdd&#8221;][vc_column_text]A complaint submitted directly to Decorpita and a complaint entered in the physical or electronic Complaints Book are separate mechanisms.<\/p>\n<p>Consumers may:<\/p>\n<p style=\"padding-left: 40px;\">a) Contact Decorpita directly to seek a solution;<\/p>\n<p style=\"padding-left: 40px;\">b) Use the physical Complaints Book;<\/p>\n<p style=\"padding-left: 40px;\">c) Use the Electronic Complaints Book;<\/p>\n<p style=\"padding-left: 40px;\">d) Refer the matter to an alternative dispute resolution entity;<\/p>\n<p style=\"padding-left: 40px;\">e) Bring proceedings before a court or use another legally available remedy.<\/p>\n<p>&nbsp;<\/p>\n<p>Use of one mechanism does not necessarily prevent use of another, subject to the applicable rules, jurisdiction and time limits.<\/p>\n<p>Submitting a complaint does not automatically suspend any statutory, judicial, contractual, limitation or expiry period.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;11. Alternative consumer dispute resolution&#8221; tab_id=&#8221;1786458950214-f29dddb9-0cfb&#8221;][vc_column_text]Alternative consumer dispute resolution provides mechanisms through which certain consumer disputes may be resolved outside the ordinary courts by independent and authorised entities.<\/p>\n<p>Depending on the competent entity and applicable procedure, the following mechanisms may be available:<\/p>\n<p style=\"padding-left: 40px;\">a) Legal information;<\/p>\n<p style=\"padding-left: 40px;\">b) Mediation;<\/p>\n<p style=\"padding-left: 40px;\">c) Conciliation;<\/p>\n<p style=\"padding-left: 40px;\">d) Arbitration.<\/p>\n<p>&nbsp;<\/p>\n<p>Consumer arbitration centres may receive and assess complaints, provide information to the parties, seek an amicable settlement and, where they have jurisdiction, refer the dispute to an arbitral tribunal.<\/p>\n<p>Portugal has several authorised consumer dispute resolution entities operating according to geographical area, subject matter and, in some cases, the value of the dispute.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;12. Information concerning ADR entities&#8221; tab_id=&#8221;1786458984534-34868579-62b0&#8243;][vc_column_text]Suppliers of goods and service providers must inform consumers of the alternative dispute resolution entities to which they are bound by membership or as a result of compulsory arbitration.<\/p>\n<p>The information must be provided in a clear, comprehensible and easily accessible manner on the business operator\u2019s website and, where applicable, in written contracts or another durable medium.<\/p>\n<p>The competent entity will depend on factors including:<\/p>\n<p style=\"padding-left: 40px;\">a) The place where the contract was concluded or performed;<\/p>\n<p style=\"padding-left: 40px;\">b) The location of the establishment;<\/p>\n<p style=\"padding-left: 40px;\">c) The consumer\u2019s residence in certain distance contracts;<\/p>\n<p style=\"padding-left: 40px;\">d) The value of the dispute;<\/p>\n<p style=\"padding-left: 40px;\">e) The subject matter of the dispute;<\/p>\n<p style=\"padding-left: 40px;\">f) The rules and jurisdiction of the relevant entity.<\/p>\n<p>[\/vc_column_text][\/vc_tta_section][\/vc_tta_accordion][\/vc_column][vc_column width=&#8221;1\/2&#8243;][vc_tta_accordion style=&#8221;modern&#8221; active_color=&#8221;#FFFFFF&#8221; color=&#8221;#0A6689&#8243; active_title_color=&#8221;#0A6689&#8243; inactive_title_color=&#8221;#FFFFFF&#8221; spacing=&#8221;16px&#8221; c_icon=&#8221;chevron&#8221; collapsible_all=&#8221;true&#8221; active_section=&#8221;30&#8243; css_animation=&#8221;none&#8221; el_class=&#8221;TxtAccordeon&#8221;][vc_tta_section title=&#8221;13. Other competent entities<\/strong><\/p>\n<p>Where the dispute does not fall within the jurisdiction of the entities identified above, consumers may consult the official list or use the public search service to identify the competent centre according to location, subject matter and the circumstances of the contract.<\/p>\n<p>Acceptance and handling of any complaint will remain subject to the territorial, material and financial jurisdiction of the selected entity.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;14. Low-value consumer disputes&#8221; tab_id=&#8221;1788127967801-6d377638-87c0&#8243;][vc_column_text]Consumer disputes not exceeding the jurisdictional threshold of the Portuguese courts of first instance \u2014 currently <strong>EUR 5,000.00<\/strong> \u2014 are subject to compulsory arbitration or mediation where the consumer expressly elects to submit the dispute to an arbitral tribunal operating within a legally authorised consumer arbitration centre.<br \/>\nIn such circumstances, submission of the dispute by the consumer to the legally competent centre may require the business to participate in the proceedings regardless of whether it has previously entered into a voluntary full-membership arrangement.<br \/>\nThe consumer will be informed at the beginning of the proceedings that they may be represented by a lawyer or solicitor and may apply for legal aid where they do not have sufficient financial means.<br \/>\nFor higher-value disputes, the availability of arbitration will depend on the centre\u2019s rules and jurisdiction, any relevant membership arrangement and, where required, agreement between the parties.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;15. Voluntary membership by Decorpita&#8221; tab_id=&#8221;1788127967849-b6f7f108-2d3e&#8221;][vc_column_text]The identification of alternative dispute resolution entities on this page does not, in itself, constitute a declaration that Decorpita has entered into full voluntary membership of the relevant centres.<\/p>\n<p>Decorpita will participate in proceedings where:<\/p>\n<p style=\"padding-left: 40px;\">a) Participation is required by law;<\/p>\n<p style=\"padding-left: 40px;\">b) Decorpita has joined the competent entity;<\/p>\n<p style=\"padding-left: 40px;\">c) Decorpita has agreed to submit the dispute to the procedure;<\/p>\n<p style=\"padding-left: 40px;\">d) Another applicable contractual or statutory obligation applies.<\/p>\n<p>&nbsp;<\/p>\n<p>Any future voluntary membership of an arbitration centre should be expressly identified on this page and in any other required documentation.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;16. Procedure and arbitral decisions&#8221; tab_id=&#8221;1788127967893-7a9c8c33-527b&#8221;][vc_column_text]The applicable procedure will be governed by law and by the rules of the selected dispute resolution entity.<\/p>\n<p>Depending on the circumstances:<\/p>\n<p style=\"padding-left: 40px;\">a) The entity may seek to resolve the dispute through mediation;<\/p>\n<p style=\"padding-left: 40px;\">b) A conciliation attempt may take place;<\/p>\n<p style=\"padding-left: 40px;\">c) The matter may be referred to arbitration;<\/p>\n<p style=\"padding-left: 40px;\">d) Documents and other evidence may be requested;<\/p>\n<p style=\"padding-left: 40px;\">e) A technical assessment or expert examination may be carried out;<\/p>\n<p style=\"padding-left: 40px;\">f) Fees may apply in accordance with the centre\u2019s rules.<\/p>\n<p>&nbsp;<\/p>\n<p>An arbitral award is binding on the parties and may be enforced in accordance with applicable law.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;17. Supporting documents&#8221; tab_id=&#8221;1788127967943-16b147f6-a307&#8243;][vc_column_text]Consumers submitting a complaint to an alternative dispute resolution entity should retain and provide all relevant evidence, including:<\/p>\n<p style=\"padding-left: 40px;\">a) The proposal or quotation;<\/p>\n<p style=\"padding-left: 40px;\">b) Order confirmation;<\/p>\n<p style=\"padding-left: 40px;\">c) Contract or accepted terms;<\/p>\n<p style=\"padding-left: 40px;\">d) Invoice or proof of payment;<\/p>\n<p style=\"padding-left: 40px;\">e) Delivery documents;<\/p>\n<p style=\"padding-left: 40px;\">f) Photographs;<\/p>\n<p style=\"padding-left: 40px;\">g) Technical reports or assessments;<\/p>\n<p style=\"padding-left: 40px;\">h) Communications exchanged with Decorpita;<\/p>\n<p style=\"padding-left: 40px;\">i) Any complaint previously submitted;<\/p>\n<p style=\"padding-left: 40px;\">j) Decorpita\u2019s response;<\/p>\n<p style=\"padding-left: 40px;\">k) A clear description of the remedy sought.<\/p>\n<p>&nbsp;<\/p>\n<p>The entity may request further information or documentation to assess its jurisdiction and review the case.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;18. Cross-border disputes&#8221; tab_id=&#8221;1788127967988-a62df378-3fff&#8221;][vc_column_text]Consumers residing in another European Union country, Iceland, Norway or the United Kingdom may seek information from the European Consumer Centre in their country of residence regarding a cross-border consumer dispute.<\/p>\n<p>The European Consumer Centre Network provides information and assistance in seeking an amicable resolution of disputes between consumers and businesses located in different countries.<\/p>\n<p>Assistance from a European Consumer Centre does not replace access to the courts and does not automatically suspend judicial or other statutory time limits.<br \/>\n[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;19. Former European Online Dispute Resolution Platform&#8221; tab_id=&#8221;1788127968034-65f3592e-2a59&#8243;][vc_column_text]The former European Online Dispute Resolution Platform \u2014 the ODR Platform \u2014 has been discontinued.<\/p>\n<p>The submission of new complaints ended on 20 March 2025, and the Regulation establishing the platform was repealed with effect from 20 July 2025. Decorpita\u2019s Website will therefore not provide links or instructions relating to the former platform.<\/p>\n<p>The discontinuation of the ODR Platform does not affect national alternative dispute resolution mechanisms or access to authorised consumer arbitration centres.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;20.
